Terms and Conditions
The applicant is the owner, purchaser, or lessee of the property identified above and requests that Northern Sunrise County provide snowplowing services for the applicant's private driveway when such driveway becomes impassable or hazardous due to snow conditions.
The applicant and Northern Sunrise County agree as follows:
1. Snowplowing Service
(a) Northern Sunrise County agrees to snowplow the private driveway of the applicant when so requested by the applicant. Such snowplowing shall only be undertaken at the discretion of the County and only be provided if County employees are not required for public roads. The equipment to be used for this service will be a one-ton pick-up truck with a blade. A truck rate of $30 plus GST per one-half hour will apply.
(b) A second level of service will include the use of a grader at the cost of $150 plus GST.
2. Snowplow Request Flags and Fees
(a) The applicant agrees to pay Northern Sunrise County Thirty Dollars ($30) plus GST per Snowplowing Request Flag for the one-ton pick-up or One Hundred and Fifty Dollars ($150) for the grader (hereinafter referred to as the flag or flags) purchased from the County. Flags are to be pre-paid by the applicant.
(b) The applicant agrees that each flag purchased will entitle the resident to have the driveway snowplowed for a maximum time limit of 30 minutes per occurrence. Any truck time in excess of 30 minutes per occurrence will be billed to the applicant at the truck rate of $60 per hour. Any grader time in excess of 30 minutes per occurrence will be billed to the applicant at the grader rate of $300 per hour. All charges will be calculated to the nearest one-quarter (ΒΌ) hour. The County employee will remove the flag once the driveway is cleared.
(c) The applicant will phone the County office before 9:00 a.m. each weekday in order to receive this service. This service will only be provided Monday to Friday.
(d) The applicant is responsible for having the driveway plowed on a regular basis to prevent the accumulation of compact snow.
3. Right to Refuse Service
Northern Sunrise County shall have the right to refuse to snowplow any private driveway that, in the opinion of the snowplow or grader operator, is hazardous or difficult to snowplow.
4. Refunds
The applicant shall not be entitled to a refund for any purchased snowplow flags unless the resident moves from Northern Sunrise County.
5. Unused Flags
Flags not used during the current year may be retained and used the following year.
6. Ownership of Flags
Snowplow request flags shall remain the property of Northern Sunrise County at all times.
7. Residential Access Only
This Agreement is intended to provide access to a residence and shall not apply to snowplowing granaries, corrals, or other areas that form part of a farming operation.
8. Termination
Either party may terminate this Agreement by providing not less than thirty (30) days' written notice to the other party.
9. Indemnification
The applicant agrees to indemnify and save harmless Northern Sunrise County, its servants, agents, and employees from and against all loss, damage, or injury, however caused, which may at any time during the continuance of this Agreement occur to any person or the property of any person, including the applicant.
10. Assignment
The applicant shall not assign or transfer any interest under this Agreement without first obtaining the written consent of Northern Sunrise County.
